Certain urban planning activities do not require a prior license but instead allow for a Responsible Declaration. This is a formal statement where the applicant declares that the planned urban activity complies with all applicable urban and sectoral regulations. The declaration also affirms that the applicant has the necessary supporting documentation and will provide it to the City Council upon request, committing to maintain compliance throughout the activity.
Submitting the responsible declaration authorizes the holder to commence works (e.g., in homes, commercial premises, or activities) and/or exercise the declared activity. Its effects take place upon registration in the City Council’s records, provided that all required documentation is attached, and the requirements of Article 28 of Ordinance 6/2022 are met. The declaration is subject to subsequent municipal verification, control, and inspection.
Steps to follow:
  1. Initial Review: Read the general guidelines and, for activities, the specific guide for responsible declarations for economic activities. Confirm whether the activity is subject to the responsible declaration regime and verify feasibility, existing licenses, and prior records.   2. Fee Payment: Complete the self-assessment form for the urban planning services fee and make the payment using one of the established methods. If performing works, also pay the Construction, Installation, and Works Tax (ICIO) and any other applicable fees based on the planned activity
  3. Documentation Preparation: Gather the required supporting documents to attach to the declaration. You can review these in the “Documentation” tab of the electronic procedure on the City Council’s website.
  4. Submit the Responsible Declaration: File the responsible declaration through the electronic platform or, if applicable, in person. Identification and electronic signature systems are required.
  5. Effect of Submission: Upon registration of the declaration, the effects are immediate if all required documentation has been submitted and the necessary conditions are met. The City Council or an authorized collaborative entity may conduct subsequent verification, control, and inspection activities.
