Certain urban planning activities do not require a prior license but can be initiated with a Responsible Declaration. In this declaration, the applicant confirms under their responsibility that the proposed project complies with all relevant urban planning and sectoral regulations. The applicant must provide the necessary documentation proving this compliance and agree to make it available to the City Council if required. They must also commit to maintaining compliance throughout the project.
This process is outlined in Article 53 of the Ordinance on Urban Planning Licenses and Responsible Declarations.
The Responsible Declaration for First Occupation and Operation applies to the initial occupation and operation of new buildings, partial occupation and operation, expansion, and intensified use. It also covers activities regulated by Law 17/1997 on Public Shows and Recreational Activities. This declaration is required for all residential uses and for non-residential uses based on the Ordinance on Urban Planning Licenses and Responsible Declarations (OLDRUAM).
This declaration must be submitted for projects approved with prior urban planning licenses. For projects carried out through a responsible urban planning declaration, the declaration for first occupation and operation is not required.

- Pay the Required Fees: Complete the self-assessment form
- Prepare the Necessary Documentation: Collect all required documents to accompany your application. You can find the full list in the “Documentation” section of the online procedure.
- Submit the Responsible Declaration: Submit the declaration via the online platform or, if necessary, in person. Ensure you have the required identification and electronic signature system.
- Inspection and Verification: Within 3 months of submitting the declaration, municipal technical services or collaborating entities will conduct an inspection. They will issue a report confirming whether the project complies with the declaration. The City Council or collaborating entity may carry out further checks and inspections as needed.
